PLAYMAR.IO TERMS AND CONDITIONS

These Terms and Conditions («Terms») govern the purchase, download, access, and use of Playmar digital products made available through Gumroad.

If you purchase, download, access, or use any Playmar product, you agree to be bound by these Terms.

1. Company Information

Playmar products are provided by:

In these Terms, «Playmar», «we», «us», or «our» means MARKETING MADE EASY S.L.

«You» or «Customer» means any person or entity purchasing, downloading, accessing, or using a Playmar product.

2. Nature of the Products

Playmar offers standalone digital gamification products that are made available for download and self-implementation. Each game mechanic is a separate product and may be offered on different pricing tiers.

Our products may include, depending on the selected product and tier:
   • a ready-made game mechanic;
   • game design and visual templates;
   • source code or implementation code;
   • setup and launch instructions;
   • technical implementation materials;
   • optional support and launch assistance for a specified number of hours.

The Customer acknowledges that the product is delivered as a digital file and does not include hosting, platform access, or done-for-you implementation unless expressly stated.

The Customer acknowledges that basic technical knowledge may be required to implement and use the product.

Unless expressly stated otherwise, Playmar products are pre-built digital products and not custom software development services created from scratch.

3. Product Line

Playmar offers a variety of interactive digital products, including gamified experiences and promotional tools, available in different versions such as free, paid, and demo. The composition and functionality of these products may be updated or expanded from time to time.

4. Product Tiers

Depending on the specific product listing, Playmar may offer one or more of the following tiers:

4.1 Free Demo or Free Basic Versiona

A free version may be provided for preview, testing, or limited use.

Such version may have restricted functionality, limited number of cards/offers, limited customization, branding limitations, or other feature restrictions.

The demo version is provided for preview purposes only and may not include full functionality, customization options, or features available in paid versions.

4.2 Standard Paid Tier

The standard paid tier may include:
   • the design of the game;
   • templates and visual assets;
   • the game code or technical files;
   • instructions on how to launch and use the product.

Under the standard paid tier, the Customer is responsible for implementation, setup, hosting, testing, compliance, and launch.

4.3 Extended Tier with Support

The extended tier may include the same materials as the standard paid tier, plus implementation support, consulting, onboarding, and launch support, for the number of hours or scope specified in the product listing or in a separate written agreement.

Unless otherwise stated, support is limited to the scope expressly described in the relevant Gumroad product page or written communication.

5. Purchase Through Gumroad

Playmar products are sold through Gumroad, which acts as the commerce and delivery platform for our storefront. Gumroad’s terms, policies, payment rules, privacy rules, and other applicable platform requirements apply to all purchases made through Gumroad. Gumroad states in its terms that it may act as a merchant of record or a non-exclusive reseller for eligible digital products, handle payment providers, facilitate delivery to buyers, and manage refunds and disputes at its discretion.

By purchasing any Playmar product through Gumroad, you agree that you are also bound by the applicable Gumroad rules and policies, including without limitation:
   • Gumroad Terms of Service;
   • Gumroad Privacy Policy.

It is your responsibility to review and comply with the current versions of those policies before making a purchase.

If any payment processing, invoicing, checkout, refund processing, dispute handling, or account-related issue is governed by Gumroad’s platform rules, such rules shall apply in addition to these Terms. Gumroad also explains in its privacy policy that it processes buyer information in connection with sellers’ sales and may act as processor for seller-related buyer data in certain contexts.

6. License and Permitted Use

Subject to full payment where applicable and continued compliance with these Terms, Playmar grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased product for your internal business purposes or otherwise in accordance with the applicable license model specified in the relevant product listing.

For the avoidance of doubt, the license granted to the Customer is non-exclusive. Playmar retains full ownership and intellectual property rights and may sell, license, distribute, or otherwise make the same or similar product available to any number of other customers without restriction.

Unless expressly allowed in writing, you may not:
   • resell, sublicense, redistribute, share, publish, or commercially exploit the product as a standalone asset;
   • sell, transfer, rent, lease, or assign the product to any third party;
   • claim Playmar materials as your own intellectual property;
   • remove copyright, trademark, attribution, or proprietary notices;
   • copy the product for multiple clients, brands, or projects beyond the scope of the purchased license;
   • make the source files, templates, or code publicly available;
   • use the product in unlawful, misleading, fraudulent, defamatory, infringing, or harmful campaigns;
   • use the product for spam, unsolicited communications, deceptive practices, dark patterns, manipulative user flows, or any unethical or non-compliant marketing activities.

If you require a broader commercial, agency, multi-brand, or multi-client license, this must be agreed with us separately in writing.

For clarity, the product is licensed, not sold.

7. Intellectual Property

All rights, title, and interest in and to the Playmar products, including but not limited to all code, designs, templates, visual assets, documentation, know-how, brand elements, and related materials, remain the exclusive property of MARKETING MADE EASY S.L. and/or its licensors.

The purchase of a product does not transfer ownership of the intellectual property. It grants only a limited, non-exclusive license as expressly described in these Terms and in the relevant product listing.

For the avoidance of doubt, Playmar retains the unrestricted right to sell, license, distribute, modify, update, or otherwise commercialize the same product, or any version, variation, or derivative thereof, to any other customer without limitation.

Any customizations, edits, or adaptations made by you do not transfer ownership of the original Playmar product or underlying materials.

8. Customer Responsibilities

You are solely responsible for:
   • selecting the appropriate product and tier for your needs;
   • reviewing the product description before purchase;
   • implementing, configuring, testing, hosting, and launching the product, unless support is expressly included;
   • ensuring that your technical environment is compatible with the product requirements;
   • ensuring that your campaign content, offers, promotions, copy, visual assets, and data collection practices comply with all applicable laws and regulations;
   • obtaining all necessary permissions, consents, and rights for any content, personal data, trademarks, or third-party materials used by you with the product.

You are responsible for final review and approval before any launch or publication.

9. Support and Services

Any support, consulting, launch assistance, or implementation guidance is provided only if expressly included in the purchased tier or separately agreed in writing.

For the purposes of these Terms, «support hours» means the amount of time allocated for providing assistance to the Customer in relation to the use of the product, including consultations, troubleshooting, and guidance. The number of support hours and the scope of services included within such hours are defined by the purchased tier or product listing.

Unless otherwise stated:
   • support is provided remotely;
   • support hours, if included, must be used within the period specified in the offer or product listing; if no such period is specified, support hours must be used within 30 days from the date of purchase;
   • unused support hours are non-refundable and non-transferable unless otherwise agreed in writing;
   • support does not include custom development beyond the stated scope;
   • support does not include legal review, marketing compliance review, or third-party platform approvals.

To activate support, the Customer must contact Playmar using the contact details provided on the Gumroad product page. A Playmar representative will review the request, clarify the scope, and confirm how the support will be delivered.

Support hours are tracked and recorded by Playmar, and all time spent providing support is deducted from the available balance.

Any additional work outside the included scope may be quoted and billed separately.

Support does not include full implementation, third-party integrations, or custom development unless expressly agreed.

10. No SaaS, No Hosting, No Ongoing Platform Obligation

Playmar products are downloadable or otherwise deliverable digital assets and not a hosted software platform.

Unless expressly stated in the relevant offering, Playmar does not provide:
   • continuous hosting;
   • cloud access;
   • ongoing platform maintenance;
   • uptime commitments;
   • account infrastructure;
   • subscriber dashboards;
   • automatic updates;
   • permanent compatibility with all future systems, browsers, integrations, or third-party services.

Any references to setup, support, or technical assistance do not convert the product into a SaaS service.

Product Updates and Versions. Playmar products are dynamic and may be updated, modified, improved, or changed over time at our discretion.

The version of the product available at the time of purchase is the version licensed to the Customer.

Unless expressly stated otherwise in the product listing or agreed in writing, Playmar is not obligated to provide any updates, upgrades, new versions, or modifications released after the date of purchase.

Any future versions, improvements, or additional features may be offered separately, including as new products, paid upgrades, or different tiers.

11. Delivery

Delivery of the product is made through Gumroad or by the method specified in the relevant product page.

It is your responsibility to provide a correct email address and maintain access to the Gumroad account, download page, or other delivery channel used for the purchase.

We are not responsible for delivery failures caused by incorrect buyer information, Gumroad account restrictions, spam filtering, firewall limitations, or issues outside our reasonable control.

12. Demo, Preview, and Informational Materials

Any demo version, sample, screenshot, mockup, preview page, or descriptive material is provided for illustrative purposes only.

Unless expressly stated otherwise, demo versions are intended to demonstrate the product concept, user flow, and available customization options. A demo is not a representation that every feature, integration, or result shown will be included in every tier or every product version.

Demo materials and previews may differ from the final product depending on the selected tier and configuration.

13. Pricing, Taxes, and Payment

All prices are as shown on the applicable Gumroad product page at the time of purchase, unless a separate written offer is agreed.

Prices may be displayed excluding or including taxes depending on Gumroad’s checkout flow, applicable laws, and buyer location. Payment processing is handled through Gumroad and its payment infrastructure. Gumroad’s terms note that it uses third-party payment providers including Stripe and PayPal.

You are responsible for any taxes, duties, levies, withholding obligations, or similar government charges applicable to your purchase or use of the product, except where such amounts are required by law to be collected and remitted by Gumroad or another party.

14. Refunds and Cancellations

Because Playmar products are digital products delivered through Gumroad, refunds, disputes, and chargebacks may be subject to Gumroad’s applicable policies and procedures. Gumroad’s terms expressly state that Gumroad handles buyers’ refund requests, chargebacks, and disputes in its discretion.

Unless otherwise required by applicable law or expressly stated on the specific product page:
   • free products and demo products are not refundable;
   • digital files that have been delivered, downloaded, accessed, or made available are non-refundable, except where required by law;
   • support, consulting, and implementation time already used is non-refundable;
   • custom or partially customized work, if any, is non-refundable once work has started.

Nothing in these Terms limits any non-waivable consumer rights that apply under mandatory law.

By completing the purchase and accessing or downloading the product, the Customer expressly agrees to immediate performance of the digital content and acknowledges that they may lose any applicable right of withdrawal once access is granted, to the extent permitted by law.

Refunds are not provided once the product has been downloaded or accessed, except where required by applicable law.

15. Third-Party Services and Integrations

Playmar products may be used together with third-party software, hosting providers, marketing tools, website platforms, or other external services.

Unless expressly agreed otherwise, Playmar is not responsible for:
   • the availability, security, legality, or performance of third-party services;
   • changes made by third-party providers;
   • compatibility issues caused by third-party tools, plugins, browsers, operating systems, or hosting environments;
   • downtime, limitations, blocks, or policy restrictions imposed by third parties.

The Customer is responsible for reviewing and complying with all third-party terms applicable to its implementation and use of the product.

16. Compliance, Promotions, and End-User Campaigns

You are solely responsible for ensuring that any campaign, promotion, giveaway, discount, prize mechanic, contest, or data collection activity implemented using a Playmar product complies with all applicable laws, regulations, platform policies, advertising rules, consumer protection rules, and privacy requirements in the jurisdictions where you operate.

This includes, without limitation, laws relating to:
   • promotions and prize draws;
   • advertising and marketing communications;
   • e-commerce;
   • consumer rights;
   • data protection and privacy;
   • cookies and tracking technologies;
   • email and direct marketing;
   • sector-specific regulations.

Playmar does not guarantee that any particular product is legally compliant for your use case without your own legal and compliance review.

17. Data Protection

To the extent the Customer uses a Playmar product to collect, process, store, export, or otherwise handle personal data, the Customer is solely responsible for ensuring a lawful basis for such processing and for providing all required notices, consents, disclosures, and technical safeguards.

Playmar does not act as the controller of end-user data simply by selling a downloadable product.

Where Gumroad processes buyer data in connection with purchases, Gumroad’s own privacy rules and data handling practices also apply. Gumroad states that for some seller-related services it may act as a processor to sellers, while sellers determine the scope of buyer information collected in connection with sales.

18. Disclaimer of Warranties

To the maximum extent permitted by law, Playmar products and any related services are provided on an «as is» and «as available» basis.

Playmar does not warrant that:
   • the products will be uninterrupted or error-free;
   • the products will be compatible with every system or environment;
   • implementation will be simple or suitable for every use case;
   • the products will meet every Customer expectation;
   • the products will be free from minor defects, bugs, or limitations;
   • the products will generate specific business, commercial, marketing, or conversion results.

The Customer acknowledges that successful use of the product depends on many factors outside Playmar’s control, including implementation quality, hosting setup, marketing execution, legal compliance, and third-party systems.

Playmar does not guarantee any specific marketing, business, or performance outcomes.

19. Limitation of Liability

To the maximum extent permitted by law, Playmar shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of business, loss of data, loss of goodwill, or business interruption.

To the maximum extent permitted by law, Playmar’s total aggregate liability arising out of or relating to any product or related service shall not exceed the amount actually paid by the Customer for the specific product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

20. Indemnity

You agree to indemnify, defend, and hold harmless Playmar, MARKETING MADE EASY S.L., its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to:
   • your use or misuse of the product;
   • your implementation, launch, or distribution of any campaign;
   • your violation of these Terms;
   • your violation of any law, regulation, or third-party right;
   • your content, promotions, offers, or end-user communications.

21. Termination of License

Your license to use the product automatically terminates if you materially breach these Terms.

Upon termination, you must stop using the affected product and, upon request, delete or cease distributing the relevant files and materials to the extent required by law and by the nature of the breach.

Sections relating to intellectual property, payment obligations, disclaimers, limitation of liability, indemnity, governing law, and any provisions that by their nature should survive, shall survive termination.

22. Changes to These Terms

We may update these Terms from time to time.

The version in force at the time of your purchase will generally apply to that purchase, unless a change is required by law or relates to ongoing support or post-sale services. The latest version may be published with the relevant product information or otherwise made available by us.

23. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of laws principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection law requires otherwise.
